The rules and conditions for using Headshot.ltd's AI headshot generation service.

Agreement to these terms

These Terms of Service ("Terms") are a binding agreement between you and Headshot.ltd ("Headshot.ltd," "we," "us," or "our") governing your access to and use of our website, applications, and AI headshot generation services (collectively, the "Service").

By creating an account, uploading photos, making a purchase, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

The service

Headshot.ltd allows you to upload reference photos and receive AI-generated professional headshots in selected backgrounds, attire styles, and formats. Features, plans, output counts, and pricing may change over time. We describe current offerings on our website at the time of purchase.

We strive for high-quality results but AI-generated images may vary. Output quality depends on your source photos, selections, and technical factors outside our control.

Eligibility & accounts

You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree to provide accurate registration information and to notify us promptly of unauthorized use. We may suspend or terminate accounts that violate these Terms or pose a security risk.

Your photos & content

You retain ownership of the photos and other content you upload ("User Content"). You represent and warrant that:

  • You own User Content or have all rights and permissions needed to upload and process it.

  • User Content does not infringe any third party's intellectual property, privacy, or publicity rights.

  • If others appear in a photo, you have their consent to upload and process the image for headshot generation.

  • User Content complies with applicable law and our Acceptable Use rules below.

To operate the Service, you grant Headshot.ltd a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and display User Content solely to provide, maintain, and improve the Service for you. This license ends when User Content is deleted from our systems, except where retention is required by law or legitimate business records.

Generated headshots & your rights

Subject to your payment for the applicable plan and compliance with these Terms, you receive full ownership of the headshots and related outputs we generate for you from your User Content, including all commercial usage rights. You may use generated headshots for LinkedIn profiles, company websites, marketing materials, press kits, and other personal or commercial purposes without additional fees owed to us.

Headshot.ltd does not claim ownership over your generated outputs. We may temporarily store outputs to deliver them to your dashboard and allow download, as described in our Privacy Policy.

We do not use your uploads or generated headshots to train AI models. Your content is processed only to fulfill your request.

Acceptable use

You agree not to:

  • Upload content you do not have rights to use, including photos of others without consent.

  • Use the Service to create deceptive, defamatory, harassing, or unlawful material.

  • Attempt to reverse engineer, scrape, overload, or interfere with the Service or its infrastructure.

  • Resell, sublicense, or redistribute the Service itself (not your own generated headshots) as a competing product.

  • Misrepresent AI-generated headshots as photographs taken by a human photographer when doing so would violate applicable law or platform rules.

  • Circumvent payment, upload limits, or security measures.

Photo requirements

We may automatically validate uploaded photos for quality, face detection, and similar criteria. Photos that do not meet minimum requirements may be rejected. You are responsible for submitting suitable reference images.

Rejected uploads do not entitle you to a refund unless you have paid and we are unable to deliver any usable output through no fault of your own, in which case our refund policy below applies.

Payments & refunds

All purchases are one-time payments for the plan selected at checkout. We do not charge recurring subscription fees unless explicitly stated otherwise on the payment screen.

Payments are processed by third-party payment providers. By completing checkout, you authorize the charge for your selected plan. Prices, taxes, and included deliverables are shown before you pay.

Unless required by applicable law, all payments are non-refundable by default. We may issue refunds on a case-by-case basis where there is a valid reason — for example, a technical failure that prevented delivery of your order, duplicate charges, or other circumstances we determine warrant a refund after review.

To request a refund, contact us at the email below with your account email, order details, and a description of the issue. Approved refunds are returned through the original payment method where possible.

Promotional guarantees or marketing copy on our website (such as satisfaction guarantees) are interpreted consistently with this section and apply only as stated in the specific offer.

Processing on our servers & third parties

Your photos are processed on Headshot.ltd's servers and on third-party infrastructure used to run AI generation, storage, authentication, and payments. Those providers act on our behalf to deliver the Service. Their handling of personal data is described in our Privacy Policy.

Our intellectual property

Headshot.ltd owns the Service, including our website, software, branding, background and attire catalogs, and underlying technology (excluding your User Content and your generated outputs). You may not copy, modify, or create derivative works of the Service itself except as allowed by law.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that generated headshots will meet every professional, legal, or platform-specific requirement (for example, a particular employer's or licensing body's photo standards). You are responsible for verifying suitability before use.

Limitation of liability

To the maximum extent permitted by law, Headshot.ltd and its officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the Service.

Our total liability for any claim relating to the Service or these Terms is limited to the greater of (a) the amount you paid us for the order giving rise to the claim in the twelve months before the claim, or (b) fifty US dollars (USD $50).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Headshot.ltd from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of generated outputs, or your violation of these Terms or applicable law.

Suspension & termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service.

Sections that by their nature should survive termination — including ownership provisions, disclaimers, limitation of liability, and indemnification — will survive.

Governing law & disputes

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the courts located in the United States, unless applicable law requires otherwise.

Before filing a formal claim, you agree to contact us and attempt to resolve the dispute informally in good faith.

Changes to these terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the effective date. Material changes may be communicated by email or in-product notice. Continued use after changes take effect constitutes acceptance.
